Host Liability Waiver

DRAFT — LEGAL REVIEW REQUIRED. Replace with attorney-approved waiver before any paid event. Alcohol, premises, and short-term-rental host policy items must be confirmed by counsel.

1. Premises Authority

Host represents that they have authority to permit entertainment services at the listed location, including any required Airbnb host approval, hotel management approval, HOA compliance, or property owner consent. Host confirms that entertainment guests are permitted at the venue under applicable rental agreements, HOA rules, and local ordinances.

2. Alcohol Liability

Host is solely responsible for all alcohol present at the event. STUDS performers do not purchase, supply, or provide alcohol. Performers may assist with serving and pouring client-provided beverages. Host assumes all liability related to alcohol consumption by guests, including responsibility under Arizona's social host and dram shop laws (ARS 4-311, 4-312).

3. Premises Safety

Host represents the venue is reasonably safe, well-lit, and free of known hazards in the performance and service areas. For pool-area services, host confirms the pool area is in safe, functional condition and that no unsupervised minors will be present.

4. Venue Compliance

Host acknowledges that many short-term rental properties (Airbnb, VRBO, etc.) and HOAs have policies restricting events, gatherings, noise levels, and outside guests. STUDS is not responsible for violations of these policies. Host agrees to confirm with their property host or HOA that our service is permitted before booking.

5. Indemnification

Host agrees to indemnify and hold harmless STUDS Scottsdale, its owners, and its performers against claims arising from venue conditions, guest conduct, alcohol service, property damage caused by guests, or violations of rental/HOA policies.

6. Right of Refusal

STUDS may refuse to perform or end a service if guest conduct, intoxication, venue conditions, or safety concerns create an unsafe environment. Deposit is forfeited in this case. STUDS will document the reason and notify the host.

7. Property Responsibility

STUDS performers will treat the venue with care and clean up after service. STUDS is not responsible for damage caused by guests or pre-existing property conditions. Any damage claims must be submitted in writing within 48 hours of the event.
